Mowing Frequency

1. SERVICES

FreshCut Lawns provides professional lawn care and garden maintenance services to residential, commercial, and rural clients.

Services may include, but are not limited to:

  • Lawn mowing

  • Lawn edging

  • Whipper snipping

  • General garden maintenance

  • Weed control

  • Hedge and shrub trimming

  • Rubbish and green waste removal

  • General yard clean-ups and property maintenance

The Services also include any other lawn, garden, or property maintenance tasks agreed between the Client and FreshCut Lawns, whether agreed verbally or in writing, before or at the time of service. Any such additional tasks may incur additional charges. The scope of Services may vary depending on site conditions, seasonal growth, weather, and accessibility. 

2. MOWING FREQUENCY & SCHEDULING

Any mowing frequency (weekly, fortnightly, monthly, or otherwise) is provided as a guide only and is not guaranteed.

FreshCut Lawns is not responsible for missed services, delays, or changes to schedule due to reasonable factors including, but not limited to:

  • Weather conditions

  • Staffing availability

  • Equipment or mechanical issues

  • Access issues

  • Public holidays

  • Health and safety considerations

  • Any other reasonable operational factors

Missed services do not entitle the Client to refunds, credits, or compensation. 

3. RIGHT TO RESCHEDULE

FreshCut Lawns reserves the right to reschedule services where required to protect staff health, safety, and wellbeing, or due to operational requirements, including:

  • Weather conditions

  • Staffing availability

  • Equipment failure

  • Safety concerns

  • Any other reasonable circumstances

Services will be rescheduled at the earliest reasonable opportunity. 

4. ACCESS TO PROPERTY

The Client must provide safe, clear, and unobstructed access to the property at the scheduled service time.

If access cannot be gained, the visit will be treated as a late cancellation and charged accordingly. 

5. AUTHORITY TO ACCESS PROPERTY WITHOUT ATTENDANCE

The Client authorises FreshCut Lawns, its workers, and contractors to enter and access the property for the purpose of carrying out the Services, whether or not the Client or any other person is present at the property at the time of service.

The Client confirms that:

  • All necessary permissions have been granted to allow access

  • Gates will be unlocked or access otherwise provided

  • Animals will be secured where required

FreshCut Lawns is not responsible for delays, missed services, or additional charges resulting from restricted access, locked gates, unsecured animals, or unsafe conditions. 

6. PRICING & VARIATIONS

Pricing is based on normal site conditions and the agreed scope of Services. FreshCut Lawns reserves the right to apply additional charges where extra time, labour, or equipment is required, or where additional tasks are requested. 

7. CANCELLATION & SHORT-NOTICE FEES

The Client must provide a minimum of 24 hours’ notice to cancel or reschedule a booked service. Cancellations, rescheduling, lack of access, or client unavailability within 24 hours of the scheduled service time will incur a cancellation fee equal to 100% of the scheduled service price. 

8. ANIMAL WASTE (DOG FAECES) & HYGIENE CHARGE

The Client is responsible for ensuring lawns and work areas are free from animal waste, including dog faeces, prior to the scheduled service.

If animal waste is present at the time of service, FreshCut Lawns may, at its discretion:

  • Decline to commence or complete the service due to hygiene, health, or safety concerns; or

  • Proceed with the service and apply an additional hygiene charge.

Where FreshCut Lawns declines to carry out the service due to the presence of animal waste, the scheduled service fee remains payable in full. Where FreshCut Lawns proceeds with the service and animal waste is present, an additional charge of one (1) hour labour at $70.00 will apply to allow for:

  • Cleaning and sanitisation of equipment

  • Maintaining a clean and hygienic work environment

  • Minimising the risk of disease transmission between animals, people, and properties

This charge applies regardless of whether the Client was aware of the presence of animal waste. 

9. HEALTH, SAFETY & SITE CONDITIONS

The Client must ensure the site is reasonably safe and free from hazards, including loose debris, aggressive animals, or unsafe conditions.

FreshCut Lawns reserves the right to suspend or refuse service where conditions pose a health or safety risk. Such visits will be charged. 

10. LIABILITY & DAMAGE DISCLAIMER

To the fullest extent permitted by law, FreshCut Lawns Deniliquin is NOT responsible or liable for any loss, damage, claim, cost, or liability of any kind arising from or related to the Services provided.

This includes, but is not limited to:

  • Damage to lawns, gardens, landscaping, structures, or property

  • Damage caused by hidden, unmarked, or underground items

  • Pre-existing damage or fragile conditions

  • Irrigation systems, pipes, wiring, edging, or fixtures

  • Consequential or indirect loss

Nothing in this clause is intended to exclude liability that cannot be excluded under Australian Consumer Law. 

11. PAYMENT TERMS & LATE FEES

Payment is due within five (5) days of service completion unless otherwise agreed in writing. All service fees, cancellation fees, and additional charges form a binding payment obligation of the Client.

Late Payment Fees:

If payment is not received within 5 days:

  • A late payment fee of 25% of the outstanding balance will be applied immediately; and

  • An additional 10% of the outstanding balance will be added for every 7 days the account remains unpaid thereafter.

FreshCut Lawns may also:

  • Suspend all future services

  • Refer the debt to a collection agency

  • Recover all reasonable debt recovery costs, payable by the Client 

12. TERMINATION

Either party may terminate this Agreement by providing written notice.

All outstanding fees, charges, and incurred costs remain payable. 

13. GOVERNING LAW

This Agreement is governed by the laws of the Australian state or territory in which the Services are provided. 

14. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or representations.
