Service Policy​

1. Acceptance of Terms

By requesting, booking, accepting a quote, or allowing services to be performed by FreshCut Lawns Deniliquin (“FreshCut Lawns”), the customer agrees to these Terms & Conditions.

These terms apply to all services provided by FreshCut Lawns, whether booked through the website, phone, email, social media, or in person.

2. Services Provided

FreshCut Lawns provides outdoor property maintenance services including but not limited to:

  • Lawn mowing

  • Whipper snipping

  • Lawn edging

  • Garden maintenance

  • Yard maintenance

  • Green waste removal

  • Property clean ups

  • Street number painting

  • Electrical Test & Tag services

  • General outdoor property services

Services may be provided as one-off services or ongoing maintenance agreements.

3. Quotes & Pricing

Quotes are based on information provided by the customer and may consider:

  • Property size

  • Grass height

  • Property condition

  • Accessibility

  • Equipment required

  • Travel distance

  • Estimated time required

FreshCut Lawns reserves the right to adjust pricing where:

  • Property condition differs significantly from what was described

  • Grass height or density is excessive

  • Additional work is required

  • Hazards or obstacles are present

Where possible, customers will be notified prior to continuing work.

4. Payment Terms

Invoices issued by FreshCut Lawns are payable within 5 days unless otherwise stated.

Accepted payment methods may include:

  • Bank transfer

  • Cash

  • Other approved payment methods

Invoices may be issued electronically.

Failure to pay invoices may result in:

  • Late payment charges

  • Suspension of services

  • Referral to debt collection

  • Legal recovery action

Customers agree to pay all costs associated with debt recovery, including collection fees and legal costs.

5. Late Payment & Debt Recovery

If payment is not received by the due date, FreshCut Lawns reserves the right to:

  • Apply late payment charges

  • Suspend future services

  • Refer the debt to a collection agency

  • Initiate legal proceedings

All reasonable recovery costs will be the responsibility of the customer.

6. Property Access

Customers grant permission for FreshCut Lawns to enter the property to perform services.

Services may be performed whether or not the customer is present.

Customers must ensure:

  • Gates are unlocked

  • Pets are secured

  • Service areas are accessible

  • Hazards are removed

If access is unavailable when services are scheduled, a call-out or cancellation fee may apply.

7. Customer Responsibilities

Customers must ensure that service areas are reasonably safe and clear prior to work commencing.

This includes removing:

  • Toys

  • Tools

  • Garden hoses

  • Loose rocks

  • Furniture

  • Decorations

  • Other obstacles

FreshCut Lawns is not responsible for damage caused by objects left in work areas.

8. Hidden Objects & Underground Services

Customers must identify or remove hazards including:

  • Rocks

  • Metal objects

  • Hidden debris

  • Irrigation systems

  • Sprinkler heads

  • Electrical cables

  • Dog fences

  • Underground pipes or utilities

FreshCut Lawns is not responsible for damage to objects or underground services located within service areas.

9. Property Damage, Debris Risk & Liability

FreshCut Lawns will exercise reasonable care when performing services.

However, lawn mowing and whipper snipping involve the use of high-speed equipment which may project debris such as stones, sticks, gravel, mulch, or other materials.

Customers acknowledge that debris projection is an inherent risk of lawn and garden maintenance services.

To the maximum extent permitted by law, FreshCut Lawns will not be liable for damage caused by:

  • Stones, sticks, or debris projected during mowing

  • Hidden objects in grass or soil

  • Objects left in work areas

  • Pre-existing property defects

  • Fragile or poorly installed fixtures

  • Uneven ground or hidden hazards

FreshCut Lawns accepts no responsibility or liability for any loss, damage, or injury arising from hazards, objects, conditions, or obstacles that were not clearly visible, reasonably identifiable, or disclosed prior to work commencing. This includes any hidden, concealed, buried, obstructed, or partially visible items located within the service area, whether natural or man-made.

10. Glass, Windows & Fragile Surfaces

Glass and fragile surfaces near mowing areas are particularly susceptible to damage from projected debris.

To the maximum extent permitted by law, FreshCut Lawns will not be responsible for damage to:

  • Windows

  • Glass doors

  • Sliding doors

  • Glass fencing or pool fencing

  • Mirrors

  • Outdoor glass furniture

  • Solar panels

  • Other fragile surfaces

where such damage is caused by debris projected during the normal operation of lawn maintenance equipment.

Customers are responsible for ensuring fragile surfaces are protected where possible.

11. Equipment Damage Caused by Hidden Objects

Lawn maintenance equipment may be damaged by hidden or concealed hazards including:

  • Wire

  • Steel objects

  • Rocks

  • Hidden debris

  • Fence wire

  • Metal posts

Customers are responsible for ensuring that service areas are free from hazards that may damage equipment.

FreshCut Lawns reserves the right to recover the cost of repairs or replacement of equipment where damage is caused by hidden or undisclosed hazards on the property.

12. Animals & Pets

Customers must ensure that all animals are secured or restrained prior to services being performed.

FreshCut Lawns is not responsible for:

  • Injury to animals that approach operating equipment

  • Animals escaping from unsecured gates

  • Delays caused by unsecured animals

Customers are responsible for any injury or damage caused by animals on the property.

13. Weather & Service Delays

Services may be delayed due to:

  • Rain

  • Extreme heat

  • Wet ground conditions

  • Unsafe working conditions

  • Any other reason as determided by the business

FreshCut Lawns will reschedule services as soon as practical.

​

14. Cancellation Policy

Customers must provide at least 24 hours notice to cancel or reschedule a booking.

Failure to provide sufficient notice may result in a cancellation fee.

​

15. Ongoing Services

For customers receiving regular services:

  • Services will continue according to the agreed schedule

  • Pricing may be reviewed periodically

  • Customers will be notified of pricing changes where practical

Customers may cancel regular services with a minimum of 24 hours notice in writing.

16. Safety

FreshCut Lawns operates machinery that may present hazards.

Customers must ensure:

  • Children remain clear of work areas

  • Pets are secured

  • No persons approach equipment while in operation

FreshCut Lawns may suspend work if unsafe conditions exist.

17. Test & Tag Services

Electrical Test & Tag services are performed in accordance with relevant Australian Standards.

Customers must ensure equipment is:

  • Accessible

  • Safe to handle

  • Disconnected where required

FreshCut Lawns is not responsible for faults identified in customer equipment during testing.

​

18. Service Quality & Complaints

Customers must notify FreshCut Lawns of any concerns regarding service quality within 24 hours of service completion.

FreshCut Lawns will be given a reasonable opportunity to inspect and rectify any legitimate service issues.

Complaints raised outside this timeframe may not be accepted.

​

19. Privacy

FreshCut Lawns may collect personal information necessary to:

  • Provide services

  • Issue invoices

  • Communicate with customers

Customer information will not be sold or shared except where required by law.

​

20. Limitation of Liability

Where liability cannot be excluded under Australian law, FreshCut Lawns’ liability will be limited to the minimum extent permitted by law.

Where damage is proven to have been caused by negligence, liability will be limited to:

  • Repair of the affected item

  • Replacement of the affected item

  • Payment of reasonable repair costs

  • Re-supply of the service

FreshCut Lawns will not be liable for indirect or consequential losses including:

  • Loss of use of property

  • Loss of enjoyment

  • Loss of income

  • Inconvenience

Nothing in this Policy excludes rights under the Australian Consumer Law.

21. Termination of Services

FreshCut Lawns reserves the right to refuse or terminate services where:

  • Invoices remain unpaid

  • Unsafe conditions exist

  • Customers behave abusively or threaten staff

  • Property conditions pose unreasonable risk

Customers may terminate services with a minimum of 24 Hours notice in writing.

22. Changes to Terms

FreshCut Lawns reserves the right to update these Terms & Conditions at any time.

The most recent version will be available on the FreshCut Lawns website.

23. Governing Law

These terms are governed by the laws of New South Wales, Australia.
